Terms of Service
Please read these terms carefully before using our platform
1. Introduction
Welcome to Clarvio (the "Site"), an Instagram analytics platform that surfaces signals from publicly available profile activity. This document constitutes a legally-binding agreement ("Agreement") governing the terms of our service. BY ACCESSING AND USING THE SITE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD THIS AGREEMENT AND THAT YOU AGREE WITH THE TERMS, AS WELL AS OUR PRIVACY POLICY.
2. Account Registration & Access
To use Clarvio, you must register an account. By registering, you agree to take full responsibility for all activities that occur under your account, including account security, data access, and related actions. You must provide accurate, current information and keep your login credentials confidential.
3. Service Features
Clarvio allows users to analyze publicly available Instagram profile data, including profile changes, posts, stories, highlights, engagement signals, follower changes, and related metrics. The system uses AI to surface trends and notable changes. We do not require, request, or store your Instagram password.
4. Service Delivery
Once payment has been received, we will provide access to Clarvio services through your account. You are responsible for accessing your account to confirm that the payment has been processed and your subscription is active. All service deliveries are conducted electronically; no physical shipments are required.
5. Subscription & Billing
Clarvio is offered on a recurring subscription basis (monthly, quarterly, or yearly). Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. You can cancel at any time through your account settings; cancellation stops future renewals but does not refund the current paid cycle.
6. Credit Card Processing
All payments are processed through our third-party payment processor. We do not collect or store full payment card numbers. By making any purchase you agree to the payment processor's Terms of Service and represent that you will not violate any of their rules. You agree that upon purchasing any of our products you clearly understand and agree what you are purchasing. You agree not to file a fraud complaint or dispute via the payment processor, your credit card company, or your bank without first contacting our support team. If you submit such a complaint or dispute without prior contact, we reserve the right to suspend your account and pursue legal remedies as permitted by applicable law.
7. Refund Policy
Because Clarvio offers a non-tangible digital service that delivers data and reports immediately upon subscription, we generally do not issue refunds once the service is active and available on your dashboard. We do honor refund requests in the following cases: (a) if we continuously fail to deliver the service after good-faith attempts to resolve via support; or (b) product-not-as-described claims supported by clear evidence and submitted within 7 days of the purchase date. Refund requests must be submitted to support@clarvio.app in written form. Claims based on a change of mind or unmet personal expectations are not eligible.
8. Service Limitations
YOUR USE OF THE SITE IS AT YOUR SOLE RISK. THE SITE IS PROVIDED ON AN "AS IS" AND "AVAILABLE" BASIS. You cannot analyze private accounts or actions performed by private accounts. If a selected account becomes private after the start of your analysis, you will only receive signals captured while the account was public, and you are not eligible for a refund in such cases. Analytics capture a portion of public activity; rates may vary by account. We reserve the right to modify features and functionality of the service at any time. The service may be temporarily unavailable for repairs, upgrades, or maintenance. Interruption of service shall not serve as a basis to terminate your subscription or demand a refund of prepaid fees.
9. Relationship with Instagram
Clarvio is not affiliated with, sponsored by, or endorsed by Instagram, Meta, or any of their subsidiaries or partners. Clarvio operates completely separately from Instagram. We do not attempt to wrongfully capitalize on Instagram's reputation or trademarks. Certain features of the service depend on Instagram's public data and features available to us. If Instagram changes or removes access to public features, we may correspondingly adjust the service without liability for any refunds.
10. License to Access and Use
You may access the Site for your personal, lawful usage. Any other access or use of the Site or its content violates this Agreement and may infringe applicable copyright, trademark, or other laws. You may not access, use, or copy any portion of the Site or its content through bots, spiders, scrapers, web crawlers, indexing agents, or other automated devices. You shall not reproduce, redistribute, duplicate, copy, sell, resell, or exploit for any commercial purpose any portion of the Site without our prior written consent.
11. Prohibited Uses
Clarvio analyzes only publicly available Instagram data and is intended for legitimate analytics, research, marketing, and creator-economy use cases. You may not use Clarvio: (a) to stalk, surveil, intimidate, dox, or harass any individual; (b) to target, contact, or otherwise act against specific individuals based on signals surfaced by the service; (c) to compile or distribute dossiers on individuals for non-aggregate purposes; (d) to attempt to identify, contact, or reach private accounts; (e) to violate any laws, infringe intellectual property rights, transmit harmful code, or engage in fraud; (f) to violate Instagram's Terms of Service or Community Guidelines. You must comply with applicable laws — including GDPR, CCPA, and other privacy regulations — in your jurisdiction. We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of this clause, without refund. You assume full responsibility for any consequences of your use, including but not limited to actions taken on your Instagram account.
12. Children Protection
In accordance with the Children's Online Privacy Protection Act (COPPA), Clarvio does not knowingly collect personal information from anyone under the age of 13, nor allow such persons to register. If you are under 13, do not send any information about yourself to us. If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will delete that information promptly. If you believe a child under 13 has provided us with information, please contact support@clarvio.app.
13. User Acknowledgment
It is your sole responsibility to comply with Instagram's rules and any applicable laws in your jurisdiction. You use Clarvio at your own risk. We are not responsible for your actions or their consequences and will not be held liable if your Instagram account is suspended, restricted, or banned for any reason. You acknowledge and accept all risks associated with the use of public Instagram data.
14. Disclaimer of Warranties
YOU USE THIS SITE AT YOUR OWN RISK. THE SITE AND ITS CONTENT ARE OFFERED WITHOUT WARRANTY OF ANY KIND, INCLUDING BUT NOT LIMITED TO: (1) MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE; (2) THAT USE OF THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE; (3) THAT USE OF THE SITE WILL PRODUCE ANY PARTICULAR RESULTS; (4) THAT INFORMATION PROVIDED IS ACCURATE, CURRENT, COMPLETE, OR RELIABLE; (5) THAT DEFECTS IN THE SITE WILL BE CORRECTED; OR (6) THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
15. Limitation of Liability
To the maximum extent permitted by law, Clarvio and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the service. Our total cumulative liability for any claim shall not exceed the amount you paid to Clarvio in the twelve (12) months preceding the event giving rise to the claim.
16. Hyperlinks
The Site may include hyperlinks to third-party websites that we do not maintain or control. We are not responsible for the content of such links or any loss or damage arising from your access to or use of any external website. You agree that you will bring no claim against Clarvio arising from or based upon any such use of external websites.
17. Arbitration and Class Action Waiver
You agree to resolve any claims through an informal dispute process directed to support@clarvio.app. If the parties do not reach an agreed-upon resolution within thirty (30) days of initiating informal dispute resolution, you agree to resolve any claims through final and binding arbitration. The parties agree that arbitration shall be conducted in their individual capacities only and not as a class action or representative action, and the parties expressly waive their right to file a class action or seek relief on a class basis.
18. DMCA
The Digital Millennium Copyright Act of 1998 (the "DMCA") provides recourse for copyright owners who believe material on the service infringes their rights under U.S. copyright law. To submit a DMCA notice or counter-notice, send a written request including the information required by the DMCA to support@clarvio.app. We will respond to valid notices in accordance with the DMCA.
19. Amendments
We may amend this Agreement from time to time. When we amend this Agreement, we will update this page and indicate the date that it was last modified. You may refuse to agree to the amendments, but if you do, you must immediately cease using the service. You agree to review this page periodically; continued use after the modification date constitutes acceptance of the amended Agreement.
